This Agreement is put into effect for all Acquired Customers (Please see Terms and conditions below). The parties To this Agreement are 10Bet (UK) Ltd. ('10Bet') and the individual or entity participating in its Affiliate Program ('Associate'). The subject matter of this Agreement shall be the implementation of a link provided by 10Bet on the Associate's web site with the aim of establishing an advertising cooperation ('Affiliate Program) for the mutual Benefit of the parties hereto. This Agreement contains the terms and conditions that apply to Associate's Participation in the Affiliate Program. The Terms and conditions further set out below are an inseparable part of This Agreement. This Agreement shall be governed by and construed in accordance with English law. Any disputes Arising hereunder will be settled before the English courts.
Terms and conditions
Upon conclusion of the Agreement, a partner identification code is assigned to the Associate. By means of the assigned link codes, 10Bet registration system identifies customer referrals from the link of the Associate's web site.
’Acquired Customers’ are customers of 10Bet who (i) do not yet have a betting account with 10Bet, (ii) access 10Bet homepage via the link placed on the Associate's web site, (iii) properly register to 10Bet within 5 days. The term ‘Gross Profit’ denotes the betting sales with 10Bet in real money minus bonus or promotional amounts given to the customers, charge backs or any uncollectible revenue attributable to the customer.
The Associate shall receive either a commission of 25% allocated from the Gross Profit generated by Acquired Customers from both casino and sportsbook or 0.4% commission allocated from the customers total sportsbook turnover or a fixed fee of $50.
10Bet shall administrate the turnover generated via the links, record the Gross Profit and the total amount of commissions earned via the link, provide the Associate with turnover statistics and handle all customer services related to the business.
Each month will carry the previous month balance negative or positive
For the avoidance of doubts, statistics provided during the month might have some inaccuracies due to continuous activities or uncompleted transactions of associate's assigned customers.
Any claim to reimbursement of cost for further advertising activities of the Associate shall only be applicable if 10Bet has commissioned the Associate to do so in writing.
The Associate shall guarantee that the material shown on its web site does not infringe any rights of third parties (including copyright and trademark rights, the general right of personality or any other rights) and that it is neither libelous nor defamatory or illegal in any other way.
The Associate acknowledges that - should the promoting or soliciting of bets be prohibited under the rules and regulations of its country of domicile or be permissible only under certain preconditions not met here - it may not enter into this Agreement and shall, consequently, also not be entitled to post the link on its web site.
Associate payments are granted on a monthly basis and payable by the 15th of the month following the month in question. In order of processing a payment for a certain period, (i) the referring of at least 5 new active users for the period in question is required and (ii) payment should be for a minimum amount of $100 or equivalent. 10Bet will deduct all bonuses, charge backs and other fraudelant activities caused by customers that were directed by an affiliate from the Affiliate payment.
Holdover for Fraud Traffic. In the event that, in our sole discretion, we suspect any Fraud Traffic, then we may delay payment of the Affiliate Fees to you for up to one hundred and eighty (180) days while we investigate and verify the relevant transactions. We are not obligated to pay Affiliate Fees in respect of Players who, in our sole discretion, are not verifiably who they claim to be or are otherwise involved with Fraud Traffic. In the event that we determine any activity to constitute Fraud Traffic, or to otherwise be in contravention of this Agreement, then in our sole discretion we may: (i) pay the Affiliate Fees in full, (ii) recalculate them in light of such suspected Fraud Traffic and/or (iii) forfeit your future Affiliate Fees in respect of Fraud Traffic (as appropriate).
Should one of the contractual provisions be or become ineffective, all other stipulations of the Agreement shall continue in full force and effect.
